TERMS AND CONDITIONS

All pricing, proposals and agreements are subject to credit reports and approvals by the Company.

Payments are to be made according to the schedule set in the agreement between the Company and the Customer.

The Company shall not be liable for performances due to strikes, or labor controversies, fires, weather, inability to receive materials, or any other circumstances beyond the control of the Company, the nature of the same notwithstanding.

Upon payment in full for all work performed by the Company, the Company will provide a one (1) year workmanship warranty from the date of receipt of payment in full. All work performed by subcontractors, paid for by the customer, overseen by the Company, is subject to their warranty and the Company does not warranty any of their work. Any and all work performed by the Company which comprises any repair work or any work over another's work or repair work is not warranted.

This agreement cannot be canceled once the work has commenced unless both parties agree hereto. If the agreement is canceled by the Customer more than three (3) days from acceptance, Customer agrees to pay the Company 10% of the agreement price as liquidated damages, not as any penalty, but as fair and just compensation for the company effort up the point of such cancelation.

The company will take necessary steps to protect the property, however company is not liable for slight damages to property, interior or exterior, plant or shrubbery damage, oil drops, cracks in concrete walks or drives or any other slight damages that may occur. If excessive damage is caused by the Company, repairs will be promptly made by the company.

Any issues of any nature that may arise in the performance of work in, on, or around the job location, which require solution in order to continue the work to completion, shall be discussed with the Customer and charged as additional work.

The Company shall perform all work, as set forth herein, according to good, workmanlike practices and according to local business codes. In the event the Customer questions the workmanship of the Company, the Company will hire, at the Customer's expense, a third party to inspect the work. Any deficiencies to the work, by means of variance from the code or accepted local practices, will be promptly made by the Company.

If any dispute arises, the parties agree to go the third party arbitration no later than 30 days from completion date. If, in the event, collection is required for any amount herein, the Customer agrees to be responsible for Customer attorney fees in addition to the Company attorney fees, together with a 1.5% interest per month (18% per annum) on the unpaid balance until such time as agreement sum, attorneys fees, and interest are paid in full.

This agreement represents the entire agreement between the parties hereto. Any representations or statements or communications, not written in this agreement, are agreed to be immaterial, and are not enforceable, and do not survive the execution of this agreement. If any provision of the agreement shall be held invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.

Your signature is not required for enforcement of these Terms and Conditions. Your acceptance of the agreement (verbal or written), your deposit and/or management fee, and providing access to your property confirms both understanding and intent on your part to have the project completed as agreed upon with payments as scheduled and/or full payment at the completion of the project.  Once you have been delivered a copy of these Terms and Conditions, they will apply to all projects for which you hire the Company. These Terms and Conditions may be altered at any time and become the Terms of Service for the Company regardless of any previously delivered versions.
